SENATE BILL NO. 23

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DEPARTMENT OF SAFETY AND HOMELAND SECURITY.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 8203, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 8203. Powers, duties and functions of the Director.

The Secretary may:

(2) Appoint, and fix the salary of, with the written approval of the Governor, the following division directors who may be removed from office by the Secretary with the written approval of the Governor and who shall have such powers, duties duties, and functions in the administration and operation of the Department as may be assigned by the Secretary:

f. A director of the Office of Highway Safety who shall be is known as the "Director of the Office of Highway Safety," which position shall remain a merit position. The Director of the Office of Highway Safety shall be and who is qualified by training and experience to perform the duties of the office;

SYNOPSIS

This Act changes the employee classification of the Office of Highway Safety (OHS) director position from merit to exempt. The Department of Safety and Homeland Security (Department) is requesting the change to make the Department’s director position employee classifications consistent. The Department is seeking the change while the OHS Director position is vacant.

This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
