SENATE BILL NO. 42

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO SPECIAL LICENSE PLATES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 2140D, Title 21 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 2140D. Delaware State Fair Centennial limited edition special license plates.

(b) This section applies only to:

(1) A private passenger vehicle; or vehicle.

(2)  A vehicle that is owned by a business and does not exceed the weight limit under paragraph (b)(3) of this section.

(3) A truck or trailer with a 3/4-ton or less manufactures rated capacity; or manufacturer’s gross vehicle weight rating (GVWR) of 26,000 pounds or less, whether it is owned by an individual or an artificial entity, including a corporation, company, association, firm, partnership, society, or joint-stock company.

(3) A van with a 3/4-ton or less manufacturer's rated capacity.

SYNOPSIS

This Act expands applicability of the Delaware State Fair Centennial Limited Edition Special License Plate to vehicles with a manufacturer's gross vehicle weight rating of up to 26,000 pounds, and clarifies that vehicles owned by artificial entities qualify for this plate. This Act also removes a provision regarding vans, as that language is antiquated and no longer necessary.
