HOUSE BILL NO. 93

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DIVISION OF DEVELOPMENTAL DISABILITIES SERVICES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 7909A(c), Chapter 79, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 7909A. Division of Developmental Disabilities Services.

(c) The Division of Developmental Disabilities Services shall have the following powers and duties:

(1) Provide case management and community-based services including family supports, advocacy, foster care placements, respite, residential setting options, nurse and behavioral consultation, day services, neighborhood homes, supported living, vocational and supported employment opportunities services to assist individuals achieve their goals. and day habilitation services;

(2) Provide case management, nursing, behavioral services, therapy and other professional supports needed to assist individuals in achieving their goal or goals; and

(3) Provide early intervention services to families so as to prevent or minimize developmental delays in children at risk who are ages 0-3; and

(4) (2) Provide intermediate care facility residential services.

SYNOPSIS

This Act tightens the role and responsibilities of the Division of Developmental Disabilities Services (DDDS) so that it more aptly aligns with the current state of the agency. This act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
