SENATE AMENDMENT NO. 4

TO

SENATE SUBSTITUTE NO. 1

FOR

SENATE BILL NO. 48

AMEND Senate Substitute No. 1 for Senate Bill No. 48 on line between lines 90 and 91 by inserting the following:

“Section 3. The Department of Labor must form a stakeholder panel for the sole purpose of advising the Department on the content of the regulations promulgated under § 6962(c)(13) of Title 29 when creating the regulations and when considering revisions to the regulations. The stakeholder panel is composed of the following members or a designee appointed by a member serving by virtue of position:

(1) The Secretary of the Department of Labor, who is the Chair of the panel.

(2) A State Senator from the majority caucus, appointed by the President Pro Tem of the Senate.

(3) A State Senator from the minority caucus, appointed by the President Pro Tem of the Senate.

(4) A State Representative from the minority caucus, appointed by the Speaker of the House.

(5) A State Representative from the minority caucus, appointed by the Speaker of the House.

(6) One member, appointed by the Delaware State AFL-CIO.

(7) One member, appointed by the Delaware Building and Construction Trades Council.

(8) One member, appointed by the Delaware Contractors Association.

(9) One member, appointed by the Associated Builders and Contractors, Inc.

(10) One member of the public with expertise in public works contracting, appointed by the President Pro Tem of the Senate.

(11) One member of the public with expertise in public works contracting, appointed by the Speaker of the House of Representatives.”.

FURTHER AMEND Senate Substitute No. 1 for Senate Bill No. 48 on line 91 by deleting “Section 3.” before “This” and inserting in lieu thereof “Section 4.”.

SYNOPSIS

This Amendment creates a stakeholder panel to consult with the Department of Labor on the regulations required under this Act.
