HOUSE AMENDMENT NO. 2

TO

HOUSE BILL NO. 184

AMEND House Bill No. 184 after line 90 by inserting the following:

“Section 2. Amend § 6003, Title 7 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 6003. Permit — Required.

(c) The Secretary shall grant or deny a permit required by subsection (a) or (b) of this section in accordance with duly promulgated regulations and:

(3) No permit may be granted to a gasification facility or a pyrolysis factory unless the specific technology included in the request for the permit has demonstrated economic and technical viability in another U.S. jurisdiction for 5 or more years. ”.

SYNOPSIS

This Amendment requires that a permit for a gasification facility or a pyrolysis factory may be approved only if the specific technology the facility will use has 5 years of demonstrated economic and technical viability in another U.S. jurisdiction.
