HOUSE AMENDMENT NO. 3

TO

HOUSE BILL NO. 235

AMEND House Bill No. 235 by adding to the end of the enactment clause after the word “DELAWARE” and before the colon “:” the following: “(Two-thirds of all members elected to each house thereof concurring therein)”.

FURTHER AMEND House Bill No. 235 on line 9 by inserting “ unless the property is in a City with a population over 50,000 ” after “ tenants ” and before the period therein.

FURTHER AMEND House Bill No. 235 after line 12 and before line 13 by inserting the following:

“ (c) This section does not prohibit a jurisdiction from charging a wage tax under that jurisdictions’ ordinances on the same basis as other wages earned in that jurisdiction .”

FURTHER AMEND House Bill No. 235 on line 15 by deleting “January” as it appears therein and inserting in lieu thereof “July”.

SYNOPSIS

This amendment: (1) adds the 2/3rds vote requirement; (2) states that the exception for rental of real estate for property owners or tenants does not apply to cities with a population over 50,000; (3) adds a section stating that the bill doesn’t prohibit a jurisdiction from charging a wage tax under that jurisdictions’ ordinances on the same basis as other wages earned in that jurisdiction; and (4) changes the enactment date from January 1, 2020 to July 1, 2020.
