HOUSE BILL NO. 262

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO SPECIAL LICENSE PLATES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fifths of all members elected to each house thereof concurring therein):

Section 1. Amend § 2121A, Title 21 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 2121A. Special license plates for members of Delaware firefighters, auxiliary, and volunteer ambulance or rescue companies within the Delaware Firefighter’s Association.

(a)(1) The owner of any vehicle described in paragraph (a)(2) of this section may apply to the Department for the assignment to that vehicle of a special Delaware firefighter number; provided however, if the owner of the vehicle has official documentation which that indicates such person the owner is a bona fide member of or holds membership with a Delaware-based fire company, auxiliary of a fire company, or a volunteer ambulance or volunteer rescue company belonging to any county firefighter’s association or the Delaware State Firefighter’s Association of the State of Delaware.

(2) This section applies only to: to the following, whether owned by an individual or an artificial entity:

a. A private passenger vehicle; passenger vehicle.

b. A truck with a 3 / 4 -ton or smaller manufacturer’s rated capacity; or capacity.

c. A van with a 3 / 4 -ton or smaller manufacturer’s rated capacity.

(3) For purposes of this subsection, “artificial entity” includes a corporation, company, association, firm, partnership, society, or joint-stock company.

SYNOPSIS

This Act permits the Division of Motor Vehicles to assign special license plates for firefighters, auxiliary members, or volunteer ambulance members to vehicles owned by an artificial entity, including a corporation, company, association, firm, partnership, society, or joint-stock company.
