AN ACT TO AMEND THE DELAWARE CODE RELATING TO THE DELAWARE HEALTH INFORMATION NETWORK.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 13014, Title 16 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 10314. External and public reporting of claims data.

(c) (1) The Office of Management and Budget, State Employee Benefits Committee, Division of Public Health, State Council for Persons with Disabilities, and Division of Medicaid and Medical Assistance shall have access The DHIN shall provide access, at no cost, to all claims data reported by the Delaware Health Care Claims Database under this subchapter at no cost to the following state agencies for the purposes of public health improvement research and activities. activities:

(2) These entities are authorized to The state agencies under paragraph (c)(1) of this section may enter into appropriate agreements with the DHIN to allow the Delaware Health Care Claims Database to perform data warehousing and analytics functions that have been performed pursuant to the existing statutory authority of the Office of Management and Budget, the State Employee Benefits Committee, State Council for Persons with Disabilities, or the Department of Health and Social Services. performed by these state agencies under their existing statutory authority.

SYNOPSIS

This Act supports the ongoing work of the Primary Care Reform Collaborative to achieve better health for Delawareans at a lower cost by facilitating the sharing of de-identified health expenditure information and fostering transparency that is critical to the effective delivery of primary care in Delaware.

Specifically, this Act requires the Delaware Health Information Network (DHIN) to provide access to the Delaware Health Care Claims Database to 2 additional state agencies, the Department of Insurance and Delaware Health Care Commission. In adding these state agencies to the existing list, this Act makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
