SENATE AMENDMENT NO. 3

TO

HOUSE BILL NO. 212

AMEND House Bill No. 212, as amended, by inserting the following after line 9 and before line 10 of Senate Amendment No. 2 to House Bill No. 212:

“FURTHER AMEND House Bill No. 212, as amended, on line 31 by deleting “ 130 ” after “ than ” and before “ feet ” and inserting in lieu thereof “ 140 ”.”

FURTHER AMEND House Bill No. 212, as amended, by deleting “by deleting lines 30 through 32 in their entirety and inserting in lieu thereof the following:” on lines 10 and 11 of Senate Amendment No. 2 to House Bill No. 212 and inserting in lieu thereof “by inserting the following after line 32:”.

FURTHER AMEND House Bill No. 212, as amended, by deleting “ federally designated ” on line 27 of Senate Amendment No. 2 to House Bill No. 212.

SYNOPSIS

This Amendment restores the intent of the Bill and Senate Amendment No. 2, which is to impose a height restriction of 140 feet for existing industrial landfills.

The buffer requirements in Senate Amendment No. 2 will apply to industrial landfills not approved to accept waste as of the effective date of the Bill.
