HOUSE BILL NO. 20

AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO THE PROVISION OF FREE FEMININE HYGIENE PRODUCTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 41, Title 14 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 4141. Free feminine hygiene products in schools.

(a) For the purposes of this section, “feminine hygiene products” means tampons and sanitary napkins, for use in connection with the menstrual cycle.

(b) By the 2020-2021 school year, all public and charter schools maintaining any combination of grades 6-12 shall provide free feminine hygiene products in a minimum of ½ of bathrooms used by students who can have a menstrual cycle.

(c) Schools must publish on the school’s website and post in the school’s common areas the locations of the bathrooms where feminine hygiene products are provided.  Such information should be updated if bathroom locations are changed.

(d) Each school must consult with its school nurse regarding the feminine hygiene products to be provided.

SYNOPSIS

This bill requires all public and charter schools which have students in grades 6-12 to provide free feminine hygiene products in 50% of the bathrooms used by students who can have a menstrual cycle. This bill also requires schools to publish on its website and post in its common areas the locations of the bathrooms where the hygiene products are provided. Finally, this bill provides that each school must consult with its school nurse regarding the products to be provided.
