HOUSE BILL NO. 42

AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO INSURANCE EXAMINATIONS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 321, Title 18 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows and by redesignating accordingly:

§ 321 Examination Report.

(d) The Commissioner s hall furnish a copy of the report to the person examined not less than 20 days prior to filing the same in the Department and may, in the Commissioner’s discretion, also furnish a copy of the report to each member of the examinee’s board of directors if the person examined is a corporation. If such person so requests in writing within such 20-day period, the Commissioner shall grant a hearing as to the report and shall not so file the report until after the hearing and after such modifications have been made therein as the Commissioner deems proper.

SYNOPSIS

This Act eliminates § 321(d) since § 321(c) sets forth the accepted process for furnishing of examination reports and hearing requests by the Commissioner.
