SENATE SUBSTITUTE NO. 1

SENATE BILL NO. 62

AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO EDUCATION MINIMUM REQUIREMENTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 41, Title 14 of the Delaware Code by making deletions as shown by strike through and

insertions as shown by underline as follows:

§ 4142. Minimum requirements for a student to move into the next higher grade level or graduate.

(a) To move into the next higher grade level, a student must receive a passing grade as follows:

(1) In grades 1 through 8, in each of the following areas:

a. Mathematics, which may include basic mathematics, intermediate mathematics, advance mathematics, business mathematics, applied mathematics, or algebra. Fifty percent of mathematics must provide training without the use of a calculator, except where an individualized education plan or Section 504 plan under the 1973 Rehabilitation Act [29 U.S.C. § 701, et seq.] specifies the use of a calculator.

b. Science.

c. History.

d. English/Language Arts.

(2) In grades 9 through 11, in each of the following areas:

a. Mathematics, based on the student’s choice and including basic mathematics, intermediate mathematics, advance mathematics, business mathematics, applied mathematics, algebra, or other provided mathematic courses for a secondary level. Fifty percent of mathematics must provide training without the use of a calculator, except where an individualized education plan or Section 504 plan under the 1973 Rehabilitation Act [29 U.S.C. § 701, et seq.] specifies the use of a calculator.

b. Science.

c. History.

d. English/Language Arts.

(b) To graduate, a student must receive a passing grade in grade 12 in the following areas:

(1) Mathematics.

(2) English/Language Arts.

(3) Life skills program.

(4) The State Board’s required credits.

SYNOPSIS

This Act sets the minimum educational course requirements for each grade. It does not set the curriculum for these courses or how they will be presented within the classroom. The life skills program replaces the half credit currently listed as part of the 3.5 electives required for graduation and is not an additional half credit added to the graduation requirements.

This Substitute Bill differs from Senate Bill No. 62 by clarifying the title of the new § 4142 and correcting errors made in the drafting process, specifically the list of areas for which a student must receive a passing grade in grade 12 to graduate.
