SENATE AMENDMENT NO. 2
TO
SENATE BILL NO. 63
AMEND Senate Bill No. 63 by deleting the enactment clause in its entirety before line 1.
FURTHER AMEND Senate Bill No. 63 by inserting the following before line 1:
“WHEREAS, in recognition that PFAS chemicals, including aqueous film-forming foam (“AFFF”) used as a fire suppressant, present an emerging challenge with much yet to be learned about their negative effect on public health and the environment, this Act serves as an initial step towards reducing the use and, where used, containment of PFAS chemicals in firefighting applications, while encouraging the use of available safer alternatives, despite their additional cost and decreased effectiveness; and
WHEREAS, this Act is not intended to convey approval of the use of PFAS chemicals or the continued use of AFFF in firefighting applications, except in limited circumstances under this Act, for training, testing, and emergency use.
NOW, THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:”.

This Amendment adds a preamble to the bill to articulate the legislative intent of the bill.
