HOUSE BILL NO. 147

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO MINIMUM WAGE INCREASE ECONOMIC IMPACT ANALYSIS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 19, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 1909. Minimum wage increase economic impact analysis.

(a) The Controller General shall cause to be prepared an economic impact analysis on legislation that increases the state’s minimum wage .

(b) The economic impact analysis under this section must determine the economic impact in this State of increasing the minimum wage and, in determining the economic impact, may include the following information:

(1) Background information on the minimum wage increase.

(2) The effect of the minimum wage increase on the following aspects of State government:

a. State spending on major healthcare programs.

b. State spending on or taxation for unemployment compensation.

c. State spending on nutrition programs.

d. State spending on other mandatory programs.

e. State revenues.

f. State spending on wages of State workers.

(3) The effect of the minimum wage increase on the following:

a. Employment in this State.

b. The wages of affected workers in this State.

c. The distribution of family income in this State.

d. Real, inflation-adjusted output in this State.

e. Prices of goods and services in this State.

f. The distribution of labor and capital income in this State.

(4) The economic modeling approach adopted to analyze the effect of an increase in the state’s minimum wage on the economy.

(5) A comparison with a prior economic impact analysis issued under this section in the same General Assembly or another General Assembly within the prior 3 years.

(c) The economic impact analysis under this section must analyze the economic impact of a minimum wage increase over at least a 5-year period.

(d) Legislation required to have an economic impact analysis under this section may not be considered by the Senate or House of Representatives, or a standing committee of the Senate or House of Representatives, without the economic impact analysis required under this section.

(e) A state agency shall cooperate with a request by and provide information to the Controller General for an economic impact analysis required under this section.

(f) Section 1908 of this title does not apply to this section.

Section 2. Legislation introduced in, but not yet enacted by, the 151st General Assembly before this Act’s enactment must have a minimum wage increase economic impact analysis prepared before the legislation’s final passage.

SYNOPSIS

This Act requires the Controller General to cause to be prepared an economic impact analysis on legislation that increases the state’s minimum wage to determine the economic impact in this State of increasing the minimum wage.
