SENATE SUBSTITUTE NO. 1

FOR

SENATE BILL NO. 7

AMEND Senate Substitute No. 1 for Senate Bill No. 7, as amended, by deleting lines 28, 29, 34, 43, 52, 53, 66 through 68, and 73 and redesignating accordingly.

FURTHER AMEND Senate Substitute No. 1 for Senate Bill No. 7, as amended, by deleting line 44 and substituting in lieu thereof: “ (14) Home Invasion Burglary First Degree in violation of § 826(b) of this title. ”

FURTHER AMEND Senate Substitute No. 1 for Senate Bill No. 7, as amended by inserting after “by” and before “financial terms” on line 74, “ secured or cash only ”.

FURTHER AMEND Senate Substitute No. 1 for Senate Bill No. 7, as amended, by deleting line 76 and substituting in lieu thereof “ that offense. ”.

SYNOPSIS

This amendment removes the following crimes from the signal offense list: strangulation, assault in the second degree, rape in the third degree, arson in the first degree, burglary first degree (except home invasion burglary), stalking, possession of a deadly weapon during commission of a felony, any domestic violence offense allegedly committed while the defendant is pending adjudication on a previously charged violent felony allegedly committed against the same victim, and tier 3 drug dealing. It also alters the presumption for signal offenses to cash or secured bail rather than cash bail only.
