HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 259

AMEND House Bill No. 259 by deleting lines 8 through 9 in their entirety and inserting in lieu thereof the following:

manner to all of the following:

(1) Radio and television stations broadcasting within this state.

(2) Wireless devices through the Wireless Emergency Alerts or subsequent systems operated by federal agencies to provide authenticated emergency and life-saving information to the public. ”.

FURTHER AMEND House Bill No. 259 by deleting line 27 in its entirety and inserting in lieu thereof “ extremely hazardous substances that imminently and substantially endangers public health beyond the property boundaries of the facility. ”.

FURTHER AMEND House Bill No. 259 by deleting lines 35 through 36 in their entirety and inserting in lieu thereof the following:

“(7) “Extremely hazardous substance list” (EHSL) or “EHSL” means a compilation of EHS that meets the criteria set forth in regulated substances under § 7707 of this title. title in Regulation 1201 of Title 7 of the Delaware Administrative Code. ”.

FURTHER AMEND House Bill No. 259 by deleting lines 88 through 89 in their entirety and inserting in lieu thereof the following:

(c) If a catastrophic release requires the public to take protective action, the Department shall use emergency alerts under § 3109(b)(2) of Title 20 to communicate instructions. ”.

SYNOPSIS

This Amendment does all of the following:

1. Provides clear authority for emergency alerts to be sent to wireless devices using systems created after the system that is currently in use.

2. Revises the definition of "catastrophic release" to use the term "extremely hazardous substance" because that term is defined in § 7705 of Title 7, and to clarify that the risk to public health extends beyond the property boundaries of the facility.

3. Revises the definition of "extremely hazardous substance list" to better align with Chapter 77 and the regulations required under § 7707 of Title 7 because the regulations use different terminology.

4. Clarifies that alerts must be sent to wireless devices if the catastrophic release requires the public to take protective action.
