AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO WORKERS COMPENSATION.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 2308, Title 19 of the Delaware, by deleting subsection (b) in its entirety, and by substituting in lieu thereof the following:
"(b) Sole proprietors, partners or members of their immediate family are included within this Chapter; provided, however, that any such person may be exempted from this Chapter if he or she agrees in writing to such an exemption."
Current law exempts sole proprietors, partners or members of their immediate family from coverage under the Workers Compensation Act unless the person makes an election to be covered. This bill makes sole proprietors, partners and members of the immediate families subject to the Workers Compensation Act, but allows any such person to opt out should he or she desire.
