SENATE BILL NO. 234

AMEND Senate Bill No. 234 by deleting the Section 1 Addendum as it appears on pages A-1 through A-8 and inserting in lieu thereof a new Section 1 Addendum to read as follows:

FURTHER AMEND Senate Bill No. 234 by deleting the words "One Hundred Seventy Seven Million Dollars ($177,000,000)" as they appear on lines 17 and 18 of page 4 and insert in lieu thereof the words "Two Hundred and Three Million Eight Hundred and Thirty Nine Thousand Six Hundred Dollars ($203,839,600)".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$9,000,000" as it appears on line 26 of page 4 and insert in lieu thereof the number "$12,000,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$32,000,000" as it appears on line 27 of page 4 and insert in lieu thereof the number "$39,000,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$17,746,700" as it appears on line 29 of page 4 and insert in lieu thereof the number "$25,101,700".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$20,879,300" as it appears on line 30 of page 4 and insert in lieu thereof the number "$24,158,900".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$1,500,000" as it appears on line 31 of page 4 and insert in lieu thereof the number "$2,000,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$8,620,000" as it appears on line 1 of page 5 and insert in lieu thereof the number "$11,520,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$4,000,000" as it appears on line 6 of page 5 and insert in lieu thereof the number "$4,500,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$3,000,000" as it appears on line 7 of page 5 and insert in lieu thereof the number "$3,500,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$4,900,000" as it appears on line 8 of page 5 and insert in lieu thereof the number "$5,400,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$72,636,700" as it appears on line 9 of page 5 and insert in lieu thereof the number "$73,941,700".

FURTHER AMEND Senate Bill No. 234 by inserting after line 34 on page 6 the following:

"Brandywine - Bush School Renovations (100% State) 207,000 - -

Library Books - Statewide (100% State) 1,000,000 - -

Cape Henlopen - Agriculture Program (100% State 98,000 - -"

FURTHER AMEND Senate Bill No. 234 by deleting the number "$177,000,000" as it appears on line 38 of page 6 and insert in lieu thereof the number "$203,839,600".

FURTHER AMEND Senate Bill No. 234 by deleting the words "Thirty Two Million Dollars ($32,000,000)" as they appear on line 36 of page 10 and inserting in lieu thereof the words "Thirty Five Million Two Hundred and Seventy Thousand Dollars ($35,270,000)".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$8,000,000" as it appears on line 2 of page 11 and insert in lieu thereof the number "$11,000,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$2,000,000" as it appears on line 6 of page 11 and inserting in lieu thereof the number "$2,270,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$32,000,000" as it appears on line 7 of page 11 and inserting in lieu thereof the number "$35,270,000".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$1,500,000" as it appears on line 19 of page 12 and inserting in lieu thereof the number "$500,000".

FURTHER AMEND Senate Bill 234 by striking Section 25 as it appears on page 13 in its entirety and inserting in lieu thereof the following:

"Section 25. Newark Reservoir. The Section 1 Addendum of this Act appropriates $1,700,000 the Department of Natural Resources and Environmental Control for the Newark Reservoir project. The remainder of the funding for this project shall be the responsibility of the City of Newark. The City of Newark shall make every effort to insure that the project is consistent with the Future Water Supply Plan for Northern New Castle/Churchman’s EIS process. If the City fails to secure funds sufficient to complete this project by July 1, 2000, this appropriation shall revert to the General Fund."

FURTHER AMEND Senate Bill 234 by striking Section 30 as it appears on page 13 and 14 in its entirety and inserting in lieu thereof the following:

"Section 30. Notwithstanding the provisions of §6102A(i)(3), Title 29 of the Delaware Code, any Community Redevelopment Fund award to Sussex County Council for the Gumboro Community Association, Preservation Delaware for the Claymont Stone School, the Laurel Redevelopment Corporation or the Woodland Ferry shall not require a local match. Additionally, any Community Redevelopment Fund award to the Police Athletic League-Hockessin shall require a 40% match from said organization."

FURTHER AMEND Senate Bill No. 234 by deleting the number "$5,000,000" as it appears on line 25 of page 18 and inserting in lieu thereof the number "$10,000,000".

FURTHER AMEND Senate Bill No. 234 by deleting the words "One Million Eight Hundred Dollars ($1,800,000)" as it appears on lines 23 and 24 of page 28 and inserting in lieu thereof the words "Two Million Dollars ($2,000,000)".

FURTHER AMEND Senate Bill No. 234 by deleting the number "$1,000,000" as it appears on line 2 of page 29 and inserting in lieu thereof the number $1,100,000".

FURTHER AMEND Senate Bill No. 234 by deleting Section 108 as it appears on page 48 in its entirety and inserting a new Section 108 to read as follows:

"The Section 1 Addendum to this Act appropriates $1,000,000 to the Department of Administrative Services for Department of Transportation Land Purchase. The Department of Administrative Services shall purchase the following land parcels from the Department of Transportation for $1,000,000:

The Department of Administrative Services shall, upon purchase of the land, transfer said parcels to New Castle County for use as parkland and open space".

FURTHER AMEND Senate Bill No. 234 by redesignating Sections 125 through 128 as Sections 130 through 133 and adding new Sections 125 through 129 to read as follows:

"Section 125. Combined Sewer Overflows. The Section 1 Addendum of this Act appropriates $1,000,000 to the Department of Natural Resources for Combined Sewer Overflows. These funds shall be used for combined sewer overflows in the City of Wilmington, subject to a 1 to 1match from the City of Wilmington prior to disbursement.

Section 126. Community Redevelopment Fund. The Section 1 Addendum of this Act appropriates $11,270,000 to the Community Redevelopment Fund. Of this amount, $33,000 shall be allocated to the Metropolitan Wilmington Urban League; $100,000 to Sussex County Senior Services to construct the Coastal Leisure Center; and $1,000,000 to the Grand Opera House, Inc.

Section 127. Local Police Technology. The Section 1 Addendum to this Act appropriates $3,000,000 to the Office of the Budget for Local Police Technology. Of this amount, $157,300 shall be used to purchase a marine unit for the City of Wilmington Police Department. Disbursement of these funds shall be at the discretion of the Police Chief of the City of Wilmington.

Additionally, $150,000 shall be allocated to the City of Wilmington for a Video Surveillance Project.

Section 128. Delaware Economic Development Authority Land. The Delaware Economic Development Authority is hereby directed to deed to the City of Harrington approximately 35 acres of land, specifically the balance of tax map #180.00 01 06.00 located on the south side of Route 14."

Section 129. Pursuant to 29 Del. C., Section 8735, the Diamond State Port Corporation is hereby authorized to amend its certificate of incorporation to change the corporation’s registered office in Delaware from the Office of the Secretary of the State of Delaware, Townsend Building, Federal and Duke of York Streets, P.O. Box 1401, Dover, Kent County, Delaware, to Diamond State Port Corporation, Robert F. Senseny Building, #1 Hausel Road, Port of Wilmington, Wilmington, Delaware, 19801.

This Amendment amends the FY 2000 Capital Improvement Act by adding $30,109,600 in projects and amends certain epilogue sections and adds new epilogue sections
