AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO THE DEFINITION OF SCOOTER AND TO RULES OF THE ROAD.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
(Two-Thirds Majority of all members elected to each house thereof concurring therein):
WHEREAS, enactment of this legislation will help reduce many scooter-related injuries suffered by children; and
WHEREAS, according to the U.S. Consumer Product Safety Commission, from January through November 15, 2000 there have been more than 30,000 scooter-related injuries treated in emergency rooms nationwide; and
WHEREAS, children under the age of 15 account for about 85% of those injuries; and
WHEREAS, this legislation will help protect children under the age of 16 within the State of Delaware by requiring them to wear approved bicycle helmets while riding a scooter;
NOW, THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend §4198L(a), Title 21 of the Delaware Code by inserting "or scooter" between "any bicycle" and ", unless" in the first sentence of subsection (a).
Section 2. Amend §4198L(a), Title 21 of the Delaware Code by inserting "also" between "shall" and "apply" in the last sentence of subsection (a).
Section 3. Amend §4198L(d) Title 21 of the Delaware Code by inserting "or scooter" between "bicycle" and "is being".
Section 4. Amend §4198L(d), Title 21 of the Delaware Code by inserting a new sentence after the existing sentence as follows:
"The requirements of this section shall not apply to any person who, for religious reasons, objects to wearing a helmet."
Section 5. Amend §4198L, Title 21 of the Delaware Code by adding thereto a new subsection (f) to read:
"(f) Notwithstanding the definition of human-powered vehicles in §41981 of this subchapter, for purposes of this section scooters are human-powered vehicles."
Section 6. If any provision of this Act or the application thereof to any part or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Act which can be given effect without the invalid provision or application, and to that end the provisions of this Act are declared to be severable.
