HOUSE SUBSTITUTE NO. 1 FOR HOUSE BILL NO. 385 AS AMENDED BY SENATE AMENDMENT NO. 1 |
AN ACT TO AMEND CHAPTER 83, TITLE 11 OF THE DELAWARE CODE RELATING TO THE SURVIVORS' ELIGIBILITY FOR PENSION BENEFITS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 8325 of Title 11 of the Delaware Code by inserting after the last sentence the following:
"Any pension to a surviving spouse that has been discontinued as a result of remarriage shall be reinstated as of July 1, 2002, at the rate that the surviving spouse would have been receiving if their pension had not been discontinued.".
