AN ACT TO AMEND CHAPTER 70, TITLE 25 OF THE DELAWARE CODE RELATING TO RENT INCREASES. |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Subchapter 1, Chapter 70, Title 25 of the Delaware Code by striking §7016 in its entirety, and substituting in lieu thereof the following:
"§7016. Rent Increases.
The landlord shall give a minimum of sixty days' written notice, prior to the expiration of the rental agreement, of any increase in the rent payable by the tenant. If only the lot is rented, the tenant's rent may not be increased more than once during any twelve month period, regardless of the term of the rental agreement. If only the lot is rented, a rent increase shall not exceed the cost-of-living increase granted to Social Security beneficiaries for the same year in which the rent increase is to be effective, plus one percentage point."
SYNOPSIS

At present, §7016 provides for written notices by the landlord of any intended rent increase; and also provides that where only the lot is rented, there can be only one rental increase for any twelve-month period. This Act provides, among other things, that where only the lot is rented, the rent increase shall not exceed the cost-of-living increase granted to Social Security beneficiaries for the same year in which the rent increase is to be effective, plus one percentage point. |
