HOUSE BILL NO. 221

AN ACT TO AMEND CHAPTER 1 OF PART I OF TITLE 10 OF THE DELAWARE CODE DEALING WITH APPEALS TO THE SUPREME COURT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Subchapter III of Chapter 1 of Part I of Title 10 of the Delaware Code by adding thereto a new section to read as follows:

"§150. Time for appeal from Superior Court in Concealed Carry Permit Actions.

Any applicant or licensee may, at any time within 30 days from the date of any adverse decision or action of the Superior Court made pursuant to its administration of the provisions of 11 Del.C. §1441, appeal that decision or action to the Supreme Court."

SYNOPSIS

The purpose of this bill is to establish an appeal and a time frame within which an appeal can be taken from an adverse decision or action of the Superior Court in Concealed Carry Permit cases. No such appeal or time frame presently exists under Delaware law.
