SENATE BILL NO. 117

AN ACT TO AMEND AN ACT BEING CHAPTER 504, VOLUME 57, LAWS OF DELAWARE, AS AMENDED, ENTITLED "AN ACT TO INCORPORATE THE TOWN OF HENLOPEN ACRES" TO CLARIFY QUALIFICATIONS OF VOTERS IN MUNICIPAL ELECTIONS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Section 5, Qualifications of Mayor and Commissioners, of Chapter 504, Volume 57, Laws of Delaware, as amended, entitled "An Act to Incorporate the Town of Henlopen Acres" by adding to the end of the title the phrase "and Voters" so that the title reads as follows:

"Section 5. Qualification of Mayor and Commissioners and Voters."

Section 2. Amend Section 5, Qualifications of Mayor and Commissioners, of Chapter 504, Volume 57, Laws of Delaware, as amended, entitled "An Act to Incorporate the Town of Henlopen Acres" by striking Subsection (d) in its entirety and substituting in lieu thereof the following:

"(d)

(1) Every property owner, whether an individual, trust, partnership, corporation or limited liability company shall have one vote.

    1. A entity other than an individual shall vote by a person named in a certificate signed by the president, vice-president or person with authority, attested by the secretary or an assistant secretary, and with the corporate or appropriate seal affixed. A partnership shall vote by a person named in a certificate signed by all of the general partners. No vote shall be cast by a person named in a certificate given pursuant to this paragraph until the certificate is filed with the Town Manager. A new certificate shall be required for each election.
    2. Every citizen of the United States, State of Delaware, and Town of Henlopen Acres who is not a property owner but who has been a resident for a period of three hundred sixty-five (365) days immediately preceding the day of the election and is over the age of eighteen (18) shall have one vote."

SYNOPSIS

This amendment to the Charter of the Town of Henlopen Acres clarifies that any property owner may vote in Town elections as well as residents who have been residents for a period of three hundred sixty-five (365) days prior to the date of election.
