HOUSE BILL NO. 612

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO PENALTIES TO BE IMPOSED UPON CONVICTION OF DRIVING UNDER THE INFLUENCE WHILE DRIVING A VEHICLE USED FOR THE TRANSPORTATION OF SCHOOL CHILDREN.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 2708(d), Title 21 of the Delaware Code by deleting the "." at the end of that subsection and by inserting in lieu thereof the following:

"however, the school bus endorsement of any person whose endorsement was suspended, revoked or disqualified due to a conviction or offense set forth in § 4177B(e)(1) of this Title, when such conviction or offense arose from the person's driving or operation of a vehicle used for the transportation of school children, shall not be renewed and such person shall be permanently disqualified from again obtaining a school bus endorsement.".

SYNOPSIS

This Bill provides for the revocation of the school bus endorsement of a driver convicted of driving a vehicle used for the transportation of school children while under the influence, regardless of whether it is a first or subsequent offense, and will prevent such person from ever again obtaining a school bus endorsement. The same penalties would apply in the case of one convicted of reckless driving if the charge has been reduced from a charge of driving a vehicle while under the influence.
