HOUSE BILL NO. 201

AN ACT TO AMEND PART I, TITLE 14 OF THE DELAWARE CODE TO PROVIDE FOR STUDENT CHOICE TO PARTICIPATE IN ANIMAL EXPERIMENTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Part 1, Title 14, Delaware Code by adding thereto a new Section 4132 to read as follows:

"Section 4132. Student Choice Policy.

    1. As used in this section:

    1. 'Animal' means a living organism of the kingdom animalia. The term includes a cadaver or part of a cadaver of an animal.
    2. 'Student' means an individual enrolled in any grade from kindergarten through grade twelve in a public or non-public school of this State.

    1. A student may decline to participate in, or view, the activity of dissection, vivisection, incubation, capturing, harming, or killing animals. Students must be informed of any such activity at least three weeks prior to the scheduled activity and, on the day the activity is scheduled, must be given opportunity to decline to participate in the activity.
    2. A student who declines to participate in an activity pursuant to this Section shall not be penalized for declining to participate but may be required to perform an alternative project or participate in an alternative activity designed by the teacher to provide another method for obtaining the knowledge, information, or experience covered by the course of study. The alternative project or activity should involve time and effort comparable to the activity in which the student declines to participate and must be graded in a comparable manner.
    3. The local school board or other governing authority of a school, the principal of a school, or the supervisor of the science curriculum of a school must inform all teachers in writing of the provisions of this section and the policy must be included in any curriculum guide or course selection guide prepared by the district or the school.".

SYNOPSIS

This bill gives school students a choice as to whether or not to participate in projects involving animal dissections. If they choose not to participate, they may be required to participate in alternative projects designed to convey the information covered by the course.
