SENATE BILL NO. 399

AN ACT TO AMEND TITLE 20 OF THE DELAWARE CODE RELATING TO EMERGENCY ORDERS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §3116(a)(5) of Title 20, Delaware Code, by striking the phrase "within 14 days" as it appears ion the fourth sentence of such subsection and replacing such phrase with the phrase "within 60 days".

SYNOPSIS

Current law relating to the declaration of states of emergency concerning droughts provides that a public hearing shall be held "within 14 days" of the imposition of mandatory restrictions concerning water use in the event of drought. This Act would provide greater flexibility to the Department of Natural Resources and Environmental Control, the Governor's Drought Advisory Committee, and the Governor, by permitting such hearing to be held within 60 days of the imposition of any mandatory restrictions.
