HOUSE BILL NO. 599

AN ACT TO AMEND VOLUME 73, CHAPTER 275 OF THE LAWS OF DELAWARE RELATING TO THE EFFECTIVE DATE AND CREATING AN IMPACT STUDY GROUP RELATIVE TO THE CLEAN INDOOR AIR ACT.

WHEREAS, Volume 73, Chapter 275 of the Laws of Delaware, formerly Senate Bill No. 99 of the 141st General Assembly of the State of Delaware, was enacted on May 27, 2002; and

WHEREAS, it is expected that there will be a loss to the various industries benefiting from the video lottery, i.e. horseracing, tourism and related businesses; and

WHEREAS, there could be an impact upon charitable gambling activities such as bingo nights; and

WHEREAS, there may be financial impact upon various alcoholic beverage serving establishments; and

WHEREAS, it is expected that there will be a loss of business at the three video lottery establishments in Delaware and thereby a loss of revenue to the State; and

WHEREAS, there was no fiscal note prepared for said legislation; and

WHEREAS, there are practical issues relating to effective enforcement of the new Act; and

WHEREAS, the General Assembly and Governor of the State of Delaware believe it is in the best interest of the citizens of Delaware to gather and evaluate relevant information relating to the impact of the Clean Indoor Air Act before such Act becomes effective.

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Volume 73, Chapter 275 of the Laws of Delaware by striking "Section 14" thereof in the entirety and substituting in lieu thereof the following:

"Section 14. (a) There is hereby created the Clean Indoor Air Act Impact Review Study Group. This Study Group shall have the following membership:

    1. The State Budget Director, who shall Chair this Study Group; and
    2. The Controller General; and
    3. The Chair and Vice Chair of the General Assembly’s Joint Finance Committee; and
    4. One member of the Delaware Economic and Financial Advisory Committee; and
    5. The State Auditor; and
    6. A member appointed by the Governor.

    1. The Clean Indoor Air Act Impact Review Study Group shall:

    1. review all relevant data and information relating to the economic, financial and enforcement impact upon the State of Delaware occurring or expected to occur as a result of enactment of Volume 73, Chapter 275 of the Laws of Delaware; and
    2. Submit a written report summarizing all such economic and financial impacts to the Governor and General Assembly by December 15, 2002.

Section 15. This Act shall become effective January 31, 2003.".

SYNOPSIS

This Act changes the effective date of the new Clean Indoor Air Act from November 27, 2002, to January 31, 2003, and creates an Impact Review Study Group to evaluate all relevant data and information relating to the economic impact of the new Clean Indoor Air Act.
