HOUSE BILL NO. 339

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO VEHICLES THAT MUST STOP AT RAILROAD CROSSINGS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 4163, Title 21 of the Delaware Code, by striking the phrase ", except as hereinafter provided," as it appears in the first sentence of subsection (a) thereof and by striking subsection (b) thereof in its entirety.

SYNOPSIS

This Act requires any motor vehicle carrying passengers for hire, any school bus carrying any school child, and any vehicle carrying explosive substances or flammable liquids as a cargo or part of a cargo to come to a complete stop before crossing a railroad track making Delaware law consistent with the laws of surrounding states.
