HOUSE BILL NO. 139

AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO MOBILE HOMES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 313, Chapter 3, Title 9, of the Delaware Code by striking said section in its entirety.

SYNOPSIS

This bill eliminates an old land use statute that overrides County zoning ordinances and authorizes one mobile home per farm of less than 50 acres and two mobile homes on farms of more than 50 acres. This statue predates county zoning ordinances, and planning departments. Specific land use regulations such as this should be determined by the local governments.
