SENATE AMENDMENT NO. 2 TO HOUSE BILL NO. 16 |
AMEND House Bill No. 16 by adding the following sections:
"Section 2. Amend §2702, Chapter 27, Title 11, Delaware Code by redesignating subsections (14) through (54) as subsections (15) through (55).
Section 3. Amend §2702, Title 27, Title 11, Delaware Code by redesignating subsections (14) thereto to read as follows:
'(14) Section 840A of this title (Use of illegitimate retail sales receipt or Universal Product Code Label) only if punishable as a Class A misdemeanor;'"
FURTHER AMEND House Bill No. 16 by striking the word "to" as it appears on Line 4 between the words "cheat" and "defraud," and substituting in lieu thereof the word "or".
SYNOPSIS

This Amendment provides jurisdiction to the Justice of the Peace Court over the misdemeanor offense under this section, which is consistent with the other types of criminal offenses over which the Justice of the Peace Court has jurisdiction, and also corrects a typographical error. |
