HOUSE BILL NO. 392

AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO SPECIFIC OFFENSES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 1325(c) of Title 11 of the Delaware Code by striking the number “$1000” and replacing thereto with:

“$2300 and up to 40 hours of community service and for a second or subsequent offence within three years shall be subject to an enhanced fine of $5,000 and a jail sentence of 60 days, all of which may be served at Level 4 in the discretion of the court”.

Section 2. Amend § 1325(d) of Title 11 of the Delaware Code by striking the number “$5,000” and replacing thereto with:

“$10,000 and up to 160 hours of community service at the SPCA or comparable facility, and for a second or subsequent offense within three (3) years shall be subject to an enhanced fine of $25,000 and a jail sentence of one (1) year, all of which may be served at Level 4 in the discretion of the court”.

This Bill updates the animal cruelty law in Delaware.
