SENATE BILL NO. 315

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO CONTRACTING.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 29, Delaware Code, §6902(23) by deleting the phrase “means 1 or more agency representatives” and inserting in lieu thereof the following language: “means 2 or more agency or non-agency representatives, one of whom shall be an agency representative”, and further by adding the following two sentences to the end of subsection (23): “Non-agency representatives shall be limited to expected users of the materials and/or services being procured and/or persons having technical expertise deemed necessary by the agency. In no event shall non-agency representatives be affiliated with a vendor or prospective vendor of the contract.”

SYNOPSIS

This Bill allows non-State employees to participate in user groups. User groups give technical advice to the Division of Support Services concerning materials and non-professional service contracts.
