SENATE AMENDMENT NO. 1 TO SENATE BILL NO. 60 |
AMEND Senate Bill No. 60 by deleting lines 18 through 21, and replace them with the following:
"‘(b) Any person who intentionally, knowingly, or recklessly (i) makes any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained under this chapter, or under any permit, rule, regulation or order issued under this chapter, or (ii) who falsifies, tampers with, or renders inaccurate any monitoring device or method required to be maintained under this".
FURTHER AMEND Senate Bill No. 60 by deleting lines 30 through 31, and replace them with the following:
"one result of such conduct, shall be guilty of a Class D felony and shall, upon conviction, be sentenced in compliance with the sentencing guidelines established for Class D felonies in 11 Del.C. § 4205.’"
FURTHER AMEND Senate Bill No. 60 by deleting lines 38 through 39, and replacing them with the following:
"such conduct, shall be guilty of a Class D felony and shall, upon conviction, be sentenced in compliance with the sentencing guidelines established for Class D felonies in 11 Del.C. § 4205.’"
FURTHER AMEND Senate Bill No. 60 by deleting lines 48 through 49 and replacing them with the following:
"such an act, the officer, manager, or general partner committing the act shall be guilty of a Class D felony and shall, upon conviction, be sentenced in compliance with the sentencing guidelines established for Class D felonies in 11 Del.C. § 4205. Nothing in this"
FURTHER AMEND Senate Bill No. 60 by deleting line 66 and replace it with the following:
"persons within the State of Delaware."

This amendment makes technical, non-substantive changes to Senate Bill 60, and makes its definition consistent with those in House Bill 109, a companion bill. |
