SENATE BILL NO. 259

 

AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

 


Section 1.  This Act shall be known as “Brett’s Law”.

Section 2.  Amend §4714(d), Title 16, Delaware Code by deleting the word “and” from paragraph (22), and further by deleting the period “.” from paragraph (23), and substituting in lieu thereof the phrase “; and”.

                Section 3.  Amend §4714(d), Title 16, Delaware Code by adding a new paragraph (24), to read as follows:

                                “(24) Salvia divinorum.”.    


SYNOPSIS

This Bill outlaws salvia divinorum and includes it as a Schedule I controlled substance with other hallucinogenic substances.  Salvia has been banned in two other states to date.  The Federal Drug Enforcement Agency considers salvia divinorum a “drug of concern” because of its wide availability, potential for abuse, and hallucinogenic effects.
