AN ACT TO AMEND TITLE 6 OF THE DELAWARE CODE RELATING TO RADON. |
Section 1. Amend Chapter 25, Title 6, Delaware Code by inserting a new section therein as follows:
“§2572A Radon Testing and Disclosure
(a) Except as excluded by §2577 of this subchapter, a potential seller of residential real property shall conduct at least one test for the level of indoor radon in that property within one year prior to the time the property is offered for sale.
(b) Except as excluded by §2577 of this subchapter, a potential seller of residential real property shall disclose, in writing, to the potential buyer, agent and subagent, as applicable, the results of the radon test or tests which shall have been conducted by the potential seller within one year prior to the time the property is offered for sale.
(c) For the purposes of this section, ‘conduct’ and ‘conducted’ shall mean tests done by the potential seller or at his/her request.”
Section 2. Amend §2578, Title 6, Delaware Code by adding at the end thereof the following: “Each form shall also include the results of the radon test or tests required by §2572A of this subchapter.”
SYNOPSIS

This Act requires potential sellers of residential property to test for radon prior to offering the property for sale and to disclose the results of such testing. |
