AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DEPARTMENT OF TECHNOLOGY AND INFORMATION.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


Section 1.  Amend § 9004C of Title 29 of the Delaware Code by inserting as a new subsection (15) the following:

“(15)       Develop an acceptable use policy for email communications for every State network user.  As part of the policy, monitoring of emails shall be permitted upon written request from the Agency/Branch Head. Merit and Exempt State employees in violation of such acceptable use policy will be warned, in writing, by their respective Agency/Branch Head in accordance with State Merit Rules, if covered by those rules and directed to cease immediately provided however that no such written warning shall be required if such activity is a violation of other state or federal laws, regulations or policy.”.


SYNOPSIS

This Bill empowers the Department of Technology and Information to develop an acceptable use policy for email communications on the State’s network that allows email monitoring upon Agency/Branch request and written warnings to all State employees for inappropriate use in accordance with State Merit Rules.
