HOUSE CONCURRENT RESOLUTION NO. 28

 

REQUESTING THE SECRETARY OF THE DEPARTMENT OF TRANSPORTATION ENACT AN ADMINISTRATIVE REGULATION OR POLICY REGARDING LITTERING.



 


                WHEREAS,  littering causes public health problems, is an eyesore on the roadways in the State and is downright offensive; and

                WHEREAS,  in the 1970-80s DelDOT initiated the “Pitch-In Program” designed to encourage motorists to pitch their trash in designated barrels along Delaware’s major routes; and

WHEREAS,  on April 25, 1990, Delaware’s Adopt-a-Highway Program was initiated; and

WHEREAS,  the Department of Transportation has the monumental task to keep the roads free of debris, removing litter on and within 10 feet of the roadway, utilizing prison inmates, its own maintenance staff in each county and 800+ volunteers who participate in the Adopt-a-Highway Program; and

WHEREAS,  Delaware sees a peak in trash during the summer due to the many people visiting and during major events like the NASCAR races in Dover and the Delaware State Fair in Harrington; and

WHEREAS,  those convicted of littering currently receive a small fine and perhaps community service, depending on the offense; and

WHEREAS,  the placing of a point on the driver’s record upon the conviction of littering may be a more effective deterrent to the act of littering.

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 143rd General Assembly of the State of Delaware, the Senate concurring therein, that the Secretary of the Department of Transportation Nathan Hayward is encouraged, by regulation or policy, to penalize all drivers convicted of littering by assessing a point on that driver’s license for each offense.

BE IT FURTHER RESOLVED that a suitably prepared copy of this Resolution be given to Secretary Nathan Hayward.
