HOUSE BILL NO. 505

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DEPARTMENT OF TECHNOLOGY AND INFORMATION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 904C of Title 29 of the Delaware Code by inserting as a new subsection (15) the following:

“(15) Develop an acceptable use policy for email communications for every State agency. As part of the policy, monitoring of emails on a random basis shall be permitted. State employees in violation of such acceptable use policy will be warned, in writing, and directed to cease immediately provided however that no such written warning shall be required if such activity is a violation of other state or federal laws, regulations or policy.”.

SYNOPSIS

This Bill empowers the Department of Technology and Information to develop an acceptable use policy for email communications that allows random monitoring and written warnings to State employees for inappropriate use.
