HOUSE BILL NO. 276

AN ACT TO AMEND TITLE 3 OF THE DELAWARE CODE RELATING TO PESTICIDES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 12 of Title 3 of the Delaware Code by enacting the following as a new § 1241:

"§ 1241. Restrictions on agricultural crop dusting.

Notwithstanding any provision of the Code to the contrary, crop dusting shall be permitted over agricultural lands starting at sunrise each day and shall not be restricted by any other law or regulation.".

SYNOPSIS

This Bill ensures that crop dusters will be able to perform their important tasks starting at sunrise each day.
