SENATE JOINT RESOLUTION NO. 8

EXTENDING THE TIME FRAMES FOR THE PROMULGATION OF REGULATIONS RELATED TO HOME HEALTH AGENCIES.

WHEREAS, House Bill No. 507 was passed by the 141^st General Assembly in 2002 (73 Del. Laws c. 347); and

WHEREAS, the legislation sought to ensure appropriate regulation of agencies providing in-home care to consumers of home health services; and

WHEREAS, the Division of Public Health currently regulates Home Health Agencies and is charged by House Bill No. 507 of the 141^st General Assembly with expanding its regulatory authority to include additional home health agencies; and

WHEREAS, the impact of the regulations on consumers and businesses needs to be fully considered

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives and the Senate of the 142^nd General Assembly of the State of Delaware, with the approval of the Governor, that the Division of Public Health shall promulgate final regulations in accordance with House Bill No. 507 (73 Del. Laws c. 347) no later than October 1, 2006.

SYNOPSIS

This Joint Resolution extends the period of time that the Division of Public Health has to promulgate regulations as required by HB No. 507 of the 141^st General Assembly.
