AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO NEW CASTLE COUNTY COUNCIL AND COUNCILMANIC DISTRICTS. |
Section 1. Amend Title 9 of the Delaware Code, by striking § 1141 thereof in its entirety and by substituting in lieu thereof the following:
“§ 1141. Number and term.
(a) The New Castle County Council shall consist of 13 members. The term of office for each member of New Castle County Council shall be for 4 years.
(b) Twelve members of County Council shall be elected from councilmanic districts in the County numbered First through Twelfth as described in § 1164 of this title. The terms of office of these 12 members shall be staggered so that the terms of no more than 6 members shall expire in any given year.

member of County Council shall be elected at large from
(c) Each newly elected council member shall take office on the first Tuesday in January following their election.”
Section 2. Notwithstanding any law to the contrary:
1. The terms of the officials of the New Castle County governing body elected in the 2002 general election and any special election held following the 2002 general election to fill a vacancy in a seat elected in the 2002 general election shall terminate on the 1st Wednesday in November following the 2006 general election;
2. The terms of the officials of the county governing body elected in the 2004 general election and any special election held thereafter to fill a vacancy in a seat elected in the 2004 general election, shall terminate on the 1st Wednesday in November following the 2008 general election;
3. The terms of the officials of the county governing body elected in the 2006 general election and any special election held thereafter to fill a vacancy in a seat elected in the 2006 general election, shall begin on the 1st Wednesday in November following the 2006 general election and shall terminate on the 2nd Tuesday in January following the 2010 general election;
4. The terms of the officials of the county governing body elected in the 2008 general election and any special election held thereafter to fill a vacancy in a seat elected in the 2008 general election, shall begin on the 1st Wednesday in November following the 2008 general election and shall terminate on the 2nd Tuesday in January following the 2012 general election; and
5. Following the 2010 and 2012 general elections, the terms of the officials of the county governing body shall begin and end on the 2nd Tuesday in January immediately following the general election.
Section 3. Amend Title 9 of the Delaware Code by striking § 1144 thereof in its entirety and by substituting in lieu thereof the following:
“§ 1144. Salary.
The annual salary of County Council members
shall be designated by an ordinance which has been adopted and ordained by
County Council. The salary of Council
members may be changed by County Council upon its own volition, or upon a
recommendation by the New Castle County Compensation Commission; provided,
however, that no increase shall be effective for any Council member whose term
will expire within 6 months from the time enactment of such ordinance. Members of New Castle County Council shall
receive their actual and necessary expenses incurred in the performance of
their duties of office.”
Section 4. Amend § 1145, Title 9 of the Delaware Code, by striking subsection (a) thereof in its entirety and by substituting in lieu thereof the following:
“(a) The President of the County Council shall preside over meetings of the County Council and shall have the same rights and duties including the right to vote and speak therein as other members of Council.”
Section 5. Amend Title 9 of the Delaware Code by striking § 1164 thereof in its entirety and by substituting in lieu thereof the following:
“§ 1164. Councilmanic districts.
The boundaries of the thirteen (13) councilmanic districts shall be as follows:
(1) First Councilmanic District. The first councilmanic district shall comprise all that portion of New Castle County bounded by a line beginning at the intersection of Capitol Trail and non-visible boundary (TLID: 308302) located east of the intersection of Pekin Avenue and Capital Trail, thence in a counterclockwise direction along non-visible boundaries (TLID: 308302) and (TLID: 309069) to White Clay Creek, thence southeasterly along White Clay Creek to Delaware Park Entrance, thence southerly along Delaware Park Entrance to Ogletown-Stanton Road, thence southwesterly along Ogletown-Stanton Road to South Harmony Road, thence southerly along South Harmony Road to Christiana Road, thence southeasterly along Christiana Road to West Main Street, thence southeasterly along West Main Street to East Main Street, thence southeasterly along East Main Street to the Christina River, thence northeasterly along the Christina River to non-visible boundary (TLID: 430835), thence northerly along non-visible boundaries (TLID: 430835), (TLID: 430841) and (TLID: 430847) to the Amtrak Railroad, thence easterly along the Amtrak Railroad to the intersection with Amtrak Railroad segment (TLID: 494131), thence southerly along Amtrak Railroad segment (TLID: 494131) to I-95, thence northeasterly along I-95 to the non-visible boundary (TLID: 495707), thence northerly along non-visible boundaries (TLID: 495707) and (TLID: 494732) to the boundary for the City of Wilmington, thence generally northerly and westerly along the boundary for the City of Wilmington to the intersection of North Dupont Road and Lancaster Avenue, thence northwesterly along Lancaster Pike to Centre Road, thence southwesterly along Centre Road to State Route 141, thence southerly along State Road 141 to Kirkwood Highway, thence southwesterly along Kirkwood Highway to Capitol Trail, thence southwesterly along Capitol Trail to the place of beginning.

This Act
codifies the boundaries of the New Castle County Councilmanic Districts
established following the expansion of Council to 13 members and the
resulting redistricting in This Act also accomplishes the following housekeeping measures: 1. It removes references to the former 7 member Council. 2. It changes the date on which Council members take office to the 2nd Tuesday in January following their election, effective for the next election cycles. Under existing law, newly elected Council members are required to take office before the election itself is certified and before the right to make legal challenges to the election has expired. The terms of sitting members are not effected by this change. 3. It clarifies that the annual salary of County Council members shall be designated by an ordinance which has been adopted and ordained by County Council. Existing law identifies a specific salary but goes on to state that this sum can be changed by ordinance adopted by the Council. 4. It clarifies that the President of the County Council shall preside over meetings of the County Council and shall have the same rights and duties including the right to vote and speak therein as other members of Council. Existing law combines the President’s duties on Council with how and when the President is elected. These provisions are already handled elsewhere in this Act and the Code and are therefore unnecessary. |
