SENATE BILL NO. 214

 

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO STATE GOVERNMENT, STATE PROCUREMENT AND PREVAILING WAGE REQUIREMENTS.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


Section 1.  Amend §6960(b), Title 29 of the Delaware Code (effective through June 29, 2007), by adding the following in the first sentence thereof after the words “laborers employed directly upon the site of the work,” and before the word “unconditionally”:

                “or employed off site in the custom fabrication of plumbing, heating, cooling, iron, structural steel, insulation, electrical equipment, roofing, millwork, concrete or glass,”.

Section 2.  Amend §6960(b), Title 29 of the Delaware Code (effective through June 29, 2007), by adding the following in the second sentence, after the words “easily accessible place at the site of the work,” and before the words “and that there may be withheld”:

“and in the location of the custom fabrication”.

                Section 3.  Amend §6960(c), Title 29 of the Delaware Code (effective through June 29, 2007), by adding the following at the end of the first sentence after the words “site of construction”:

                                “and at the site of the custom fabrication”.

                Section 4.  Amend §6960(c), Title 29 of the Delaware Code (effective through June 29, 2007), in the second sentence, by striking the words “and subcontractor” and adding the following after the words “The contractor”:

                                “subcontractor and custom fabricator”.

                Section 5.  Amend §6960(b), Title 29 of the Delaware Code (effective beginning June 29, 2007), by adding the following in the first sentence thereof after the words “laborers employed directly upon the site of the work,” and before the word “unconditionally”:

                                “or employed off site in the custom fabrication of plumbing, heating, cooling, iron, structural steel, insulation, electrical equipment, roofing, millwork, concrete or glass,”.

                Section 6.  Amend §6960(b), Title 29 of the Delaware Code (effective beginning June 29, 2007), by adding the following in the second sentence, after the words “easily accessible place at the site of the work,” and before the words “and that there may be withheld”:

                                “and in the location of the custom fabrication”.


SYNOPSIS

Presently, Title 29 contains two sections numbered 6960.  The first is effective until June 29, 2007.  The second becomes effective June 29, 2007, at which time it will supplant the existing §6960.  This Bill amends both sections 6960, relating to the prevailing wage requirements in State contracts, to make the prevailing wage applicable to certain off-site custom fabricators.
