HOUSE BILL NO. 304

 

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO ELECTRIC POWERED BICYCLES.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


        Section 1.  Amend § 101(52), title 21 of the Delaware Code, by striking the words “shall mean” and by substituting in lieu thereof the words “shall include”.

        Section 2.  Amend § 101(52), title 21 of the Delaware Code, by inserting immediately after the period (“.”) as it appears at the end thereof the following sentence:

“The term ‘bicycle’ also includes a two- or three-wheeled vehicle with fully operable pedals any an electric motor of less than 750 watts (1h.p.), whose maximum speed on a paved level surface, when powered solely by such motor while ridden by an operator who weighs 170 pounds, is less than 20 m.p.h.”


SYNOPSIS

This Act changes the definition of the term bicycle so it includes certain electric powered bicycles with small engines that travel less than 20 m.p.h.  Current law permits gas operated cycles but doesn’t provide for the more environmentally operated electric cycles.
