SENATE AMENDMENT NO. 1 TO SENATE BILL NO. 245 |
AMEND Senate Bill No. 245 by adding immediately at the end of the enactment clause, and before the : the following:
(Two-thirds of all members elected to each house thereof concurring therein)
FURTHER AMEND Senate Bill No. 245 on line 7 by replacing the word entity with the word agency.
FURTHER AMEND Senate Bill No. 245 on line 8 by replacing §9501(c) with §9501A(c).
FURTHER AMEND Senate Bill No. 245 on line 25 by replacing section 6105 with §6105(b).
FURTHER AMEND Senate Bill No. 245 on line 26 by replacing §9506(15) with 9505(15).
FURTHER AMEND Senate Bill No. 245 on line 28 by replacing §9501A(e) with §9501A(d).
FURTHER AMEND Senate Bill No. 245 by creating a new Section 5 of the Bill to read as follows:
Section 5. Amend Chapter 95, Title 29 of the Delaware Code by creating a new Section 9501B to read as follows:
§9501B Transportation and eminent domain.
The provisions of Section 9501A of this Title shall not apply to the acquisition of property or property rights by the Department of Transportation for any transportation facility, project, or program as defined in Titles 2, 9, 14, 17, and 29 of this Code, or as otherwise authorized by the General Assembly.
SYNOPSIS
This Amendment corrects some clerical errors. In addition, DelDOT follows detailed processes for acquiring property and property rights for a variety of transportation projects and programs under several different parts of the Delaware Code, as well as for specific projects authorized by the General Assembly. This Amendment exempts DelDOT projects and programs from the provisions of the new Section 9501A. DelDOT has special procedural requirements for its project land acquisitions which it still must follow. |
