SENATE BILL NO. 6

 

 

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO FIRE ENGINEERS, CHIEF ENGINEERS, DEPUTY FIRE CHIEFS, AUTHORIZED EMERGENCY VEHICLES, WARNING DEVICES FOR EMERGENCY VEHICLES, AND LIGHTING EQUIPMENT.

 


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


Section 1.  Amend §4106(e), Title 21 of the Delaware Code by striking the phrase “fire engineer”, in its entirety and by inserting “chief engineer” therein and further by inserting the phrase “deputy fire chief,” between “fire chief” and “assistant fire chief”.

Section 2.  Amend §4307(b), Title 21 of the Delaware Code by striking the phrase "chief fire engineer" in its entirety, and further by amending inserting therein the word "fire" between "deputy" and "chief".

Section 3.  Amend §4356(a), Title 21 of the Delaware Code by striking the phrase "fire engineer," and by substituting in lieu thereof the phrase “chief engineer” and further by inserting the phrase "deputy fire chief," between "fire chief," and "assistant fire chief" where all of these phrases appear once in the first sentence and once in the second sentence of that subsection.

Section 4.  Amend §4348(d)(3), Title 21 of the Delaware Code by deleting from that paragraph, the phrase “When installed by the vehicle manufacturer, flashing”, and by substituting in lieu thereof the phrase “Flashing headlights”.


SYNOPSIS

Sections 1, 2 and 3 adds the phrase “deputy fire chief” to 21 Del. C. §4106(e) and §4307(b) since many fire departments currently have this position.  Further it removes the position of “fire engineer” and “chief fire engineer” from the Delaware Code and substitutes the phrase “chief engineer” to unify the Code.  Section 4 provides that flashing headlights for emergency personnel can be installed on vehicles by persons other than by the vehicle’s original vehicle manufacturer.
