HOUSE BILL NO. 494

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO RULES OF THE ROAD.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 4176C(b)(2), Title 21 of the Delaware Code by inserting between “messaging device” and “, electronic” the following:

“but excluding two-way radio communications devices with a fixed placement in the vehicle,”.

Section 2. The provisions of this Act shall preempt the provisions of a municipal or county enactment regulating the use of any electronic communication device by a person operating a vehicle as defined in § 101(80) of this title.

Section 3. This Act shall take effect on the same day that House Substitute No. 1 for House Bill No. 229 takes effect.

SYNOPSIS

This Act excludes two-way radio communications devices with a fixed placement in the vehicle from the list of prohibited devices.
