SENATE AMENDMENT NO. 1 TO HOUSE BILL NO. 146 |
AMEND House Bill No. 146 by inserting new Sections 2 and 3 of the bill, to read as follows:
“Section 2. Amend § 2105(d), Title 13 of the Delaware Code by inserting the words ‘or near death’ each time they appear after the word ‘death’ and before the word ‘under’ in said subsection.
Section 3. Amend § 2105(h), Title 13 of the Delaware Code by inserting the words ‘or near death’ after the words ‘each death’ and before the comma as it appears in said subsection.”
SYNOPSIS

This Amendment makes conforming changes to enable a review panel to administer oaths and compel the attendance of witnesses whose testimony is related to a death or near death under review and to subpoena records relating to a death or near death under review. This amendment also clarifies that the records relating to any death or near death under review shall only be used by the Coordinating Counsel in the exercise of its proper function and shall not otherwise be disclosed. |
