DESCRIPTION: AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE CREATING THE
DELAWARE MEDICAL MARIJUANA ACT.

ASSUMPTIONS:
1.
Effective
upon enactment.
2.
This
legislation allows for the state-regulated, non-profit distribution of medical
marijuana to persons as suffering from chronic debilitating conditions upon certification
by a physician.
3.
The
bill stipulates that fees generated must be sufficient to offset all expenses
of implementing and administering the program; however the first year of implementation
would consist of developing regulations for the program and would require a
general fund appropriation to hire 1.0
FTE (Public Health Administrator). According
to the Department of Health and Social Services full implementation of the program
would require an additional 3.0 ASF FTES (an Investigator II, an Administrative
Specialist II and a Fiscal Management Analyst) in year 2 the Public Health
Administrator position would switch to an ASF position.
