Mitchell DESCRIPTION: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO
THE POSSESSION OF FIREARMS BY PROHIBITED PERSONS.

ASSUMPTIONS:
1.
This
Act would expand the types of individuals that could be subjected to the
enhanced minimum sentences for convictions of Possession of Firearms by Persons
Prohibited.
2. The Statistical Analysis Center has
reviewed this Act for potential bed-space impact on the Department of
Correction. Due to the complexity of the
analysis, however, SAC is unable to complete this review without a lengthy in-depth
criminal history review, including the identification of eligible individuals,
the collection of sentencing data over a 10-year period, juvenile
adjudications, and out-of-state history.
3.
The
annual cost of housing a Level V inmate is approximately $8,000 for medical and
food costs only. The total cost per bed
is $36,000 when all costs, such as staffing and utilities, are included.
