In accordance with 29
Del. C. §913, the following information is provided relating to alcoholic
liquors and movie theaters.
Description
of the Legislation
This Act would create a license that would
allow the sale and consumption of beer, wine and liquor at movie theaters.
Affected
Entities
Movie theaters that meet the minimum
qualifications and are interested in selling alcoholic beverages.
Fiscal
Impact Estimate
A movie theater applying for a license to
sell alcohol would pay $1,000 for the application fee upfront and then $1,500
biennially for the license. Of the $1,000 application fee, $600 is used by the
Commissioner of Alcohol Beverage Control for the Server Training program.
There are 9 movie theaters in the State of
Delaware. If 4 of them chose to purchase the license to
sell alcoholic liquors, the revenue would be approximately $6,000 for the
license every other year, all of which would go to the General Fund.
Each licensee is also required to pay an
additional annual fee of $100 for the “Overservice Investigation Fund,” which
helps to pay for the investigation and prosecution of licensees that serve
intoxicated individuals.
Intended
use of Revenue
Revenue
from the biennial fee would be deposited into the General Fund. The Server Training Program and the
Overservice Investigation Fund would also see additional revenue from the
one-time license application fee and Overservice Investigation annual fee respectively.
